Before using Foxiflix, you (i.e. the user, as a visitor to the website or as a user of our other products) should read this document (the “Terms”), pursuant to which we provide you with access to Foxiflix. Any use of our websites, app or any other online service on which Foxiflix or its software (feature) is hosted will be deemed to be acceptance of these Terms, i.e. you are giving your express consent to use Foxiflix under the Terms set out below, as well as your consent to the Privacy Policy. If a user does not accept the terms and conditions in full, they must refrain from using Foxiflix and leave the relevant website or product.

1. Foxilix is owned by…….. (the “Owner”) and is operated by the Owner.

Foxiflix refers to a software product or, simply put, an online service intended for personal, non-commercial purposes, such as

for the user to search for and obtain information about airline tickets and other travel services offered by third parties, including airlines, OTAs, reservation systems, hotels, etc., based on the user’s queries and the functionality of the software. (meta-search service) that are partners of the owner and to facilitate the purchase (booking) process within the supported booking interface (partial automation).

To monitor and provide users subscribed to the Foxiflix newsletter with statistical information on the prices of airline tickets and other travel products for specific destinations, as well as promotional information from Foxiflix and third parties via electronic communication channels, including emails and push notifications,

to provide authorised Foxiflix users with the ability to personalise the features of the website, including remembering custom dates and saving settings for the assisted booking process,

to provide the user with information about travel on the Foxiflix blog (for informational purposes only),

to enable the user to participate in promotions and competitions (online marketing events and special projects) organised by the owner and/or its partners in Foxiflix and related fields,

for the fulfilment of other legitimate purposes that may be fulfilled by the use of Foxiflix features exclusively through the user interface.

Important. Foxiflix is not a service that allows you to purchase airline tickets, stays, rental cars, transport services, tours or other services/products. Any business relationship with the user in relation to a purchased service found on Foxiflix is conducted on the part of Foxiflix partners. The Owner is not involved in these relationships in any way. In the event of any dispute relating to these circumstances, you agree to seek resolution from the parties who have entered into a relationship with you for the provision of the services in question, or their authorised representatives.

The publication of information and content of any kind on Foxiflix about airline tickets, products, services and providers of such services does not constitute a recommendation, instruction or solicitation to purchase any such service, nor does it constitute an evaluation or comparison of such services/partners with each other.

2. Use Foxiflix

2.1 By using Foxiflix and visiting the Owner’s websites/apps, you represent and warrant that you are of legal age in your country of residence, have the requisite legal capacity, have obtained the necessary consents and permissions when acting in the interest of another, and are providing accurate, complete and reliable information when using Foxiflix.

2.2 The Owner grants you a non-exclusive and non-transferable licence to access Foxiflix on a personal device in any country in the world, free of charge, for the immediate operational purpose of Foxiflix and solely for the lawful purposes set out in the Terms.

2.3 Interaction with Foxiflix, including the creation of search requests for airline tickets, is solely through the digital interface provided to users.

2.4 By using Foxiflix, you agree not to

not to interfere with the operation of Foxiflix in any way that could result in a breach of performance, including formulating queries by any means other than through the user interface,

not to use any program or application not authorised by the owner to interact with Foxiflix,

modify, enhance, translate into other languages, decompile, disassemble, decode, frame, emulate, violate the integrity of, or attempt to restore the source code of Foxiflix or any part thereof,

use Foxiflix or the content available there for illegal purposes or in pursuit of an improper purpose, e.g. to go to partner sites and make fraudulent bookings.

2.5 The operator has the right, at any time and at its sole discretion, to terminate the maintenance of Foxiflix, to change the functionality as well as to block a particular user and the user is obliged to stop using Foxiflix after such a request.

2.6 Through Foxiflix, users also have the ability to customise the functionality of the service to their own needs. You agree that the fact that you authorise yourself on the website/app to use your assigned account on Foxiflix and thereby gain access to certain features, such as booking assistance, offers or search history, is governed in the same manner as unauthorised access.

2.7 The Owner has the right at any time to remove your content and/or restrict other users’ access to it if such content or your actions may in any way violate these Terms, the Privacy Policy, applicable law or generally accepted rules of conduct on the Internet, or jeopardise the security of the Service or third party services and their psychological state.

3. Disclaimers and liability

3.1 The Foxiflix functionality is provided “as is”. The Owner does not warrant the error-free and uninterrupted operation of Foxiflix, its parts, components or functions, the conformity of the functionality of Foxiflix with the specific expectations of the user. The Owner does not warrant the truthfulness, accuracy, completeness or timeliness of the data provided by Foxiflix, nor does it make any other warranties not expressly stated in these Terms, including the provision of support services in connection with the use of the metasearch service or other available features.

3.2 The Lessor shall not be liable for the direct or indirect consequences of any use or inability to use Foxiflix (including the Data) and/or for any damage suffered by you and/or any third party as a result of the use, non-use or inability to use Foxiflix or any of its individual components and/or functions, including any errors or failures in its operation.

3.3 You agree to use Foxiflix in accordance with the laws of the country in which you are located and accept responsibility for violating any restrictions on the use of Foxiflix or its various features in accordance with such laws.

3.4 You are solely responsible to third parties for your actions in connection with your use of Foxiflix, even if such actions result in the infringement of the rights and legitimate interests of third parties, and for compliance with applicable laws in your use of Foxiflix.

 

4. Intellectual property

4.1 Intellectual property rights to the intellectual property objects that constitute Foxiflix and/or are used by Foxiflix (software and hardware products, interfaces, algorithms, design, interaction technology, texts, images, databases, knowledge, trademarks, trade names, other means of identification, etc.), etc.) and domain names are owned by the owner or by third parties who are the rights holders and have granted a licence to the owner, or are distributed by the owner on behalf of the rights holders.

4.2 Intellectual property and other third party content whose exclusive rights have not been licensed or owned by the Owner is displayed solely to inform users about a particular airline, OTA, booking system, etc. available on, for example, a search results page on Foxiflix.

Nothing shall be construed as a claim by us to any such third party content or as granting any licence or right to use any content displayed on Foxiflix without the express written permission of the relevant owner.

4.3 You may only use the intellectual property items defined in clause 4.1 as part of the functionality offered by Foxiflix. You agree that your use of Foxiflix does not grant you any rights in such Intellectual Property except as expressly set out in the Terms of Use.

4.4 . Any Content that Foxiflix receives from you, whether through authorisation or other use of Foxiflix, must be lawfully accessible by you and must not infringe the rights and legitimate interests of any third party or any applicable law. You grant to Owner a royalty-free, perpetual, transferable, revocable and sublicensable license to use, modify, reproduce, distribute and prepare derivative works of, publicly perform and publicly display (in any form and in any media now known or hereafter developed) all Content provided. Owner may use such content in any format, on any channel, on any platform, in any region, and has the right to translate it into other languages. When you upload or submit content to Foxiflix, you also grant Foxiflix permission and the right to use your name, likeness or other personal attributes in connection with such content.

5. Changes to the conditions and dispute resolution

5.1 The Lessor has the right to unilaterally change these Terms at any time and without prior notice. Users will be notified of changes to these Terms and their current version on this page.

5.2 Amendments to the Terms shall take effect from the date of their publication unless otherwise stated in the relevant publication.

5.3 If any provision of these Terms is held invalid for any reason, the Terms will be enforced to the maximum extent permitted by applicable law and the remaining Terms will remain valid and in force.

5.4 These Terms and all relationships relating to the use of Foxiflix shall be governed by the laws of Hong Kong unless a particular user and the Owner agree otherwise.

5.5 Any concerns or claims arising from these Terms and/or your use of Foxiflix must first be resolved through a pre-litigation dispute resolution process. In the event of a dispute, you agree to send your complaint electronically and physically to the owner at the legal address. The response period is 30 days from the date the owner receives the electronic version. If you consider that your complaint has not been resolved within the time limit set for response, you have the right to take your complaint to court under Hong Kong law.
